Taking CM’s comments – a criminal landowner that employs a criminal gamekeeper to carry out illegal raptor persecution would be prosecutable under S69 of the Act (that law in existence since 1981) and both the estate and Owner would be liable.
In this case to quote from the press release- There was no indication that Mr Stewart instructed the commission of the offences or that he even knew about them being committed. Vicarious Liability is the charge because there is no evidence that Mr Stewart took any steps to exercise due diligence in respect of shooting on his Estate.
We do have to be careful how we interpret VL and that is why I do not like it. There are much better ways of dealing with this but it needs the Govt to provide the money and resources.

Sec 69 – referring to “body corporate” offences, I have only seen used once [a fish farm owner] in Scotland. There is also the many “cause and permit” clauses in the various follow up acts to the 1981 Act – they are seldom if ever invoked, mainly due to the lack of witness evidence in the closed, fear ridden sector of society known as the shooting industry…You say we have to be careful how we invoke vicarious liability – that of course applies to the use of any legislation….This conviction is an astonishing breakthrough..many congratulations to the investigation and prosecution teams involved.
If anyone thinks there will now be a flood of such cases they dont realise the difficulties of even getting one such case to court..and the checks and balances which prevent malicious prosecutions.
Lets hope this does have a deterrent effect and cuts back on the landowner/manager/gamekeeper link of criminality which has gone on for far too long.
I am not sure I understand your objection, Bob. It is the duty of the courts to ensure the law is correctly interpreted and enforced and if the law is a teeny bit complicated in some areas then lawyers and judges are well enough trained – and paid – to be able to work their way through the complications safely. If VL is properly enforced and requires estate owners to take proactive measures to prevent illegal raptor killing it can only be helpful.
